These Terms of Use govern access to and use of the Rapture Models website, tools, and services (the
“Platform”). By creating an account, making a purchase, or using the Platform, you agree to these Terms
and to the Privacy Policy.
If you do not agree, please refrain from using the platform.
1. The service
Rapture Models provides model development services. These may include education, coaching, portfolio
and digital-presence development, styling guidance, and optional AI-assisted images or avatars.
Rapture is not a talent agency. We do not book work, represent talent, or promise engagements.
Nothing on the Platform is an offer of employment or a representation agreement.
Independent Contractors and Third-Party Creatives
Photographers, videographers, stylists, retouchers, web designers, developers, and other creatives who
work with talent or clients introduced through Rapture Models / Rapture Lab are independent
contractors, not employees, agents, or partners of Rapture.
Rapture may introduce, recommend, or coordinate with such professionals as part of development. That
introduction does not create an employment, agency, joint-venture, or partnership relationship, and it is
not a guarantee of quality, availability, licensing, insurance coverage, or results.
Unless a separate written agreement with Rapture expressly says otherwise:
• Contracts, fees, usage rights, deliverables, and disputes for freelance work are solely between the
parties to that work.
• Rapture is not liable for the acts, omissions, delays, injuries, property damage, copyright issues, or
work product of any independent contractor.
• Talent and clients are responsible for confirming credentials, insurance, releases, and the scope of any
freelance engagement.
Rapture remains responsible only for services it directly agrees in writing to provide.
2. Eligibility
You must be at least 18 years old and able to enter a contract under Florida law.
3. Accounts
You are responsible for the accuracy of your information and for activity under your account. We may
suspend or close an account if these Terms, our policies, or applicable law are violated.
4. Fees and refunds
Prices are stated at checkout or in an order confirmation. Fees are for development services and tools,
not for job placement.
Unless a written offer states otherwise:
– Digital tools, files, and AI outputs are non-refundable once delivered, except where required by law.
– Coaching sessions may be rescheduled with at least 24 hours’ notice. Sessions cancelled late or
missed are treated as delivered.
– Package purchases may be refunded within three days of payment if work has not begun. After work
has begun, unused value may be applied to other Rapture Models services at our discretion. You are
responsible for applicable taxes.
5. No guarantee of results
Rapture does not guarantee bookings, income, audience growth, agency placement, or any particular
professional outcome. Examples and testimonials are illustrative only.
6. Your content
You retain ownership of photographs, video, text, and other material you submit (“Your Content”).
You grant Rapture Models a worldwide, non-exclusive license to host, store, reproduce, adapt for
format, and display Your Content as required to operate the Platform and to perform the services you
request.
If you commission materials that feature you, Rapture may also use those materials on its website and
professional channels unless you ask us in writing to stop. We will remove such use from properties we
control within a reasonable time. We cannot control copies already published by you or by third parties.
You confirm that you have the rights needed to submit Your Content; that every person depicted is 18 or
older and has consented; and that Your Content does not depict a minor in a sexual or nude context.
7. AI-assisted images
If you use AI generation or editing, you are responsible for the references and instructions you provide.
Output may differ from a reference. You may not use outputs to impersonate another person, to create
non-consensual intimate imagery, or to depict minors.
Rapture Models does not transfer ownership of underlying software or models. You may use images
generated of you for your own portfolio and social profiles, subject to these Terms and to any third-
party tool terms.
Rapture does not sell a standalone dataset of your likeness.
8. Rapture materials
The Platform, including text, methods, design, software, and the Rapture name, is owned by Rapture or
its licensors. You receive a limited license to use the Platform for your own development. You may not
copy, resell, or scrape our materials, or suggest that Rapture represents you.
9. Acceptable use
You may not use the Platform or Rapture Models social media platforms to harass or exploit others, to
submit unlawful content, to involve minors in adult imagery, to interfere with the service, or to misstate
the nature of our relationship.
10. Independent relationship
You use the Platform as an independent individual. You are not an employee of Rapture.
11. Third-party services
Payment processors, hosting providers, social networks, and AI vendors are governed by their own
terms.
12. Disclaimers
The Platform is provided as available. To the fullest extent permitted by law, Rapture disclaims all
warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-
infringement. We do not warrant that the Platform will be uninterrupted or that AI output will be
accurate.
13. Limitation of liability
To the fullest extent permitted by law, Rapture will not be liable for indirect, incidental, special,
consequential, or punitive damages, or for lost profits or lost data.
Rapture’s total liability arising from the Platform or these Terms will not exceed the amount you paid
Rapture in the twelve months before the claim, or one hundred U.S. dollars (US $100) if you have not
paid Rapture.
14. Indemnity*
You will indemnify Rapture against claims and reasonable legal costs arising from Your Content, your use
of the Platform, or your breach of these Terms or of law.
15. Copyright
Copyright notices may be sent to Rapture Models via the Rapture Models website contact page and
should include your contact details, identification of the work, the location of the material, a statement
of good-faith belief, a statement under penalty of perjury that you are authorized to act, and your
signature.
16. Changes and termination
We may update these Terms by posting a revised version. Continued use after the new effective date
constitutes acceptance. You may stop using the Platform at any time. We may discontinue all or part of
the Platform.
17. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Exclusive venue is the state courts of Miami-Dade County, Florida.
Before filing a claim, please write to us and allow thirty days to attempt a resolution.
